Party Waiver

AGREEMENT AND RELEASE OF LIABILITY

By submitting this waiver, the undersigned parent or legal guardian ("Participant") acknowledges the following terms and conditions related to participation in activities at Party à la Kart, located at 44799 Saranac St., Ashburn, VA.

1. Assumption of Risk. Participant acknowledges that participation in the activities offered at Party à la Kart, including but not limited to physical play, gym activities, bounce houses, and other recreational activities, involves inherent risks of injury or harm. Participant voluntarily assumes all such risks.

2. Release of Liability. Participant hereby releases, waives, and discharges Party à la Kart, its owners, employees, agents, and affiliates from any and all claims, demands, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by the child named herein while participating in activities at the facility.

3. Medical Treatment. In the event of an emergency, Participant authorizes Party à la Kart staff to obtain appropriate medical treatment for the child.

4. Photography. Participant grants Party à la Kart permission to photograph or video record the child during the event for use in promotional materials, unless objection is noted below.

5. Rules and Conduct. Participant agrees to ensure the child follows all facility rules and the instructions of Party à la Kart staff at all times.

By completing the form below, Participant confirms they have read, understood, and agree to all terms of this waiver.

Before your child's special event at Party à la Kart, we kindly ask that you review and sign the Indemnity and Hold Harmless Agreement provided below. This form ensures that everyone understands the responsibilities and precautions in place to create a safe and enjoyable experience for all our guests. By signing, you acknowledge the steps we're taking to keep the environment secure and agree to oversee the safety of the children in your care during the event. Acknowledgment of Responsibility and Visitor Log

By signing below, the participant confirms their responsibility for their own safety and the safety of their child(ren) during the event. The participant also releases Party à la Kart and Karter Schools from any liability for injuries or accidents that may occur. Additionally, this document serves as a visitor log and will be shared with Karter Schools.

INDEMNITY AND HOLD HARMLESS AGREEMENT
This Agreement is made and entered into by and between PARTY A LA KART, LLC, a Virginia limited liability company (“Party”), and “Participant” named in this form. Party is engaged in the business of providing a location and activities for special events for children, such as birthday and other parties, and Participant desires to be present with a child(ren) to take part in such events. Participant acknowledges that any event wherein younger children are present and/or involved can lead to unexpected injury or damage. To minimize the likelihood of such occurrence, the parties agree as follows:
1. Party will provide the location and creation of an entertainment environment for children to enjoy an event planned by the parents.
2. Party will be providing activities, decorations, food, games or discipline, while Participant and other parents are present at the event.
3. Party will endeavor to provide a safe and secure environment, including security to prevent children from wandering away from the facility or uninvited persons from entering the activity space.
4. Notwithstanding the best and dedicated efforts by Party, Participant acknowledges that any time children gather for such events there is a possibility of injury or damage to be experienced. Participant does hereby release and hold harmless Party, its owners, members and employees from any such injury or damage, whether due to a negligent or intentional act.
5. Please know the venue is first a child care center. This child care center has cameras onsite through Watch Me Grow.
6. By signing below, I acknowledge that I am responsible for the safety and supervision of all children in attendance at the party, including those using the moon bounce. I release Party a la Kart from any liability for injuries or accidents that may occur. I agree to these terms and assume full responsibility for the children's safety.
